Welcome to Kuni, US-Market Forecaster ("we", "our", or "the Application"), developed and operated by Mert Kuni. By downloading, accessing, installing, or using the Application on Android, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Application.

The Application and its algorithmic forecasts, quantitative trajectory models (TimesFM, statistical extrapolations), momentum indicators, market sentiment scores, buy/hold/sell signals, and leaderboard metrics are provided strictly for educational, research, and personal simulation purposes only.

No Investment Recommendation: No content or signal produced by the Application constitutes investment advice, financial planning, an endorsement, or a solicitation to buy or sell any security, stock, option, or digital asset.
Risk of Financial Loss: Financial markets involve substantial risk. Past model performance, simulated trajectories, and algorithmic predictions do not guarantee future market outcomes.
Sole Responsibility: You assume full and exclusive responsibility for any trading, financial, or capital allocation decisions you make. Always consult a licensed and certified financial advisor before making actual investments.

1. Permitted Use and License

We grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on compatible Android devices under your direct control.

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to derive source code from the Application.
Scrape, extract, or bulk-harvest our backend API endpoints, precomputed forecast datasets, or CDN assets without explicit written permission.
Use the Application for any unlawful purpose or in violation of applicable financial market regulations.

2. Subscriptions & In-App Purchases (Google Play Billing)

Certain advanced features, historical horizons, and analytics within the Application require a digital membership (e.g., Gold Tier) or voluntary digital contributions (Tip Jar):

Billing Execution: All payments, subscriptions, and digital consumable items are processed securely via Google Play In-App Billing. We do not process, store, or have access to your payment card details.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless cancelled by you at least 24 hours before the renewal date via your Google Play Store > Subscriptions menu.
Refunds: Refund requests and eligibility are governed strictly by Google Play Refund Policies.

3. Data Ownership & Sandboxed Google Drive Storage

Your privacy and data ownership are foundational to our software architecture:

Local-First Storage: All portfolio simulation data, transactions, realized profit logs, and user settings are persisted locally on your device in a sandboxed SQLite/Room database.
Personal Cloud Backup: If enabled, the Application creates an encrypted backup snapshot exclusively in your personal Google Drive hidden Application Data folder (drive.appdata). We do not retain, inspect, or monetize your portfolio entries on external server databases.
Data Deletion: You can permanently delete your account and all associated cloud/local records at any time directly in the app via Settings > Account > Delete Account.

4. Disclaimer of Warranties

The Application and all contained information, market forecasts, algorithmic signals, and datasets are provided on an "AS IS" and "AS AVAILABLE" basis without warranty of any kind, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, or data accuracy.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Mert Kuni, Kuni Online, or its affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, investment losses, capital depreciation, loss of data, or operational interruptions arising out of or in connection with your use or inability to use the Application.

6. Third-Party Services & Market Data

The Application relies on market data providers, public market indices, and third-party APIs (including Google Firebase and Google Drive). We do not warrant the timeliness, completeness, or uninterrupted availability of third-party market data feeds.

7. Modifications to Terms & Service

We reserve the unilateral right to update, revise, or modify these Terms of Service periodically. Any changes will be published on this page with an updated "Last Updated" date. Continued use of the Application after revisions constitutes binding acceptance of the updated Terms.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany and the European Union, without regard to its conflict of law provisions.
